I. Information We Collect

Information that we process about you in connection with the Service falls into two categories:

(1) "Non-Personal Information", which refers to information that we collect in relation to your use of the Service, but which cannot be used to personally identify you, such as anonymous usage data, general demographic information, and referring/exit pages and URLs

(2) "Personal Information", which refers to information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with an identified or identifiable individual. The term "personal information" includes your email, date of birth and contact information, which you submit to us through the registration process for the Service (including registration for our customer loyalty program); it can also include indirect identifiers such as your IP address or device identifier.

Personal and Non-Personal Information are both referenced throughout this Privacy Policy as "your information" or "information about you".

We may collect information about you or your devices from various different sources, as described below.

1. Information collected via Technology

To access the Service you do not need to submit any Personal Information other than your date of birth. In an effort to improve the Service, however, we track loyalty data and related information about your use of the Service and your transactions with us, as well as information provided to us by your browser or device when you view or use the Service, such as the website you came from (known as the "referring URL"), your IP address, the type of browser you use, the device from which you connected to the Service, the time and date of access, and other device identifiers (such as device UUID, app version, OS/model, session IDs, and/or cart ID). We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user's browser from our servers and are stored on the user's computer hard drive. Sending a cookie to a user's browser enables us to collect Non-Personal information about that user and keep a record of the user's preferences when utilizing our services, both on an individual and aggregate basis.

The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.

Depending on the devices and technologies that you use, you may be able to control the deployment of some cookies at the browser-level. Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. As of the date on which this Privacy Policy was last updated, our Service does not currently respond to browser DNT signals. If you do not wish to be tracked, you may be able to opt out by selecting certain options in the settings of the browser or device that you use to access the Service, or by using third-party applications and programs. Note, however, that modifying or disabling our deployed cookies may cause the Service to malfunction, or may cause features of the Service to become unavailable to you entirely.

2. Information you provide us directly

In addition to the information that is automatically collected when you use the Service, to become a subscriber to the Service, you will need to create a personal profile. You can create a profile by downloading the App, or by registering with the Service online. When you register online, you will be required to enter your first and last name, email address, phone number, age, and create a user name and a password.

Alternately, you can also register for the Service by signing up to participate in our customer loyalty program. When you sign up for a loyalty account, we collect Personal Information such as your name, e-mail address, mobile phone number, preferred contact method for marketing messages, and favorite Uncle Ike's store. Participants in our customer loyalty program can also choose to submit additional information, such as your birthday, to receive birthday promotional offers.

By registering, you are authorizing us to collect, store and use your email address in accordance with this Privacy Policy. You are responsible for verifying the accuracy of the Personal Information you submit (or that is submitted on your behalf) to the Service and ensuring that any personal information that you provide is kept up to date for the purposes for which you provide it.

3. Children's Privacy

The Site and the Service are not directed to anyone under the age of 21. The Service does not knowingly collect or solicit information from anyone under the age of 21, or allow anyone under the age of 21 to sign up for the Service. In the event that we learn that we have gathered Personal Information from anyone under the age of 21 without the consent of a parent or guardian, we will delete that information as soon as possible. II. How We Use Information

We process information about you in accordance with applicable laws, including to provide, maintain, improve, and enhance our Service; to understand and analyze how you use our Service and develop new products, services, features, and functionalities, to communicate with you, to find and prevent fraud and abuse, and respond to trust and safety issues that may arise, and for other purposes for which we provide specific notice at the time the information is collected. Examples of our uses include: enabling users to set up user accounts and profiles on our Service, contacting users to respond to their questions, soliciting feedback from users, providing technical support, and informing users about promotional offers. We may also process information about you to help us improve the Service and customize the user experience, such as by analyzing use of the Service, researching and developing our Service, detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, debugging to identify and repair errors on the Service, and/or other similar activities to develop, maintain, or improve our Service.

We may also process your information to enforce our Terms of Use or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency.

We also process information about you to create aggregated Non-Personal Information in order to track trends and analyze use patterns on the Site. Such aggregated data does not allow any party to identify you or any other specific user, and is not Personal Information subject to this Privacy Policy. We use such aggregated data to maintain and operate the Service, to improve the quality of the Service, to create new services and features, and for further internal, commercial and statistical purposes.

III. How We Share Information

We do share information about you with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to users' email address for purposes of sending emails from us. Those vendors use your information only in connection with enabling us to provide the Service and for other purposes in accordance with our Privacy Policy.

We may share your information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Use, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law. If we determine that it is necessary and advisable to disclose your Personal Information, we may do so without notice to you.

In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. We reserve the right to disclose or transfer any information we have about you as part of, or during negotiations of, any merger, sale of company assets, or acquisition, or in any other situation where Personal Information may be transferred with other assets of the Company. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

Further, we may also disclose your information when you request that we do so or otherwise give your consent—for example, if you authorize the linking of your account on our Service to your accounts on third-party platforms, we may share your information with those third-party platforms as necessary to link your accounts.

IV. Our Retention of Your Information

We will retain your information for as long as it is needed for or otherwise serves the purposes outlined in this Privacy Policy, in accordance with our policies and practices, applicable law, and contractual obligations. We may need to retain your information for a longer period where we need the information to comply with regulatory or legal requirements or where we may need it for our legitimate purposes e.g. to help us respond to queries or complaints, to respond to requests from regulators, etc.

Additionally, there may be occasions where we are unable to fully delete, anonymize, or de-identify your Personal Information due to technical, legal, regulatory compliance or other operational reasons. Where this is the case, we will take reasonable measures to securely isolate such information from any further processing until such time as we are able to delete, anonymize, or de-identify it.

V. How We Protect Your Information

We implement commercially reasonable security measures designed to protect your information from unauthorized access. Nevertheless, you are responsible for securing the account that you use to access our Service. Your account is protected by your account password and we urge you to take steps to keep your information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. We do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.

VI. Your Rights Regarding the Use of Your Information

As of the "Last Updated" date above, the Company is not subject to the General Data Protection Regulation of the European Union or the United Kingdom, nor to any state-level data privacy laws of the United States, excluding Washington. If you are located outside of the United States, note that all information processed by the Company may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. By providing any information, including Personal Information, on or to the Service, you consent to such transfer, storage, and processing.

1. Use of Your Information for Marketing

When you provide your phone number and other contact information to us through a web form, verbally, or other medium, you consent receive phone calls and text messages from us, and other parties acting on our behalf, at the phone number you provide to us, even if you are on a federal or state do-not-call registry. You acknowledge and agree that your information and engagement history will be processed for use in personalized marketing communications. We may send you marketing communications and advertisements in the form of text messages, calls either through an automatic telephone dialing system or artificial or prerecorded voice call, emails, or other outreach channels.

We use the Personal Information from you for the purpose of sending you requested communications. We do not sell, rent, or share Personal Information from your consent to receive communications from us with third parties for their direct marketing purposes. The information is only used by us for the purposes set out in this Privacy Policy and by our service providers to send the requested communications. The texts and calls may be automated, contain transactional, including collections, information or marketing and promotional material. Standard message and data rates may apply. You are responsible for any charges from your mobile carrier and any delays or errors in SMS delivery caused by a mobile carrier or third-party service provider. Your consent to receive text messages is not a condition to purchase.

You have the right at any time to prevent us from contacting you for marketing purposes. When we send a promotional communication to a user, the user can opt out of further promotional communications by following the unsubscribe instructions provided in each promotional e-mail. You can also indicate that you do not wish to receive marketing communications from us in the "Unsubscribe" section of the Site. Alternately, if you have signed up to receive promotional text messages from us as part of our customer loyalty program, you may opt out of receiving such text messages by responding STOP, END, CANCEL, or QUIT, or otherwise following the opt-out instructions included in the text message.

Please note that notwithstanding the promotional preferences you indicate by either unsubscribing or opting out in the unsubscribe page of the Site, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.

3. Additional Provisions for Users of the App Available Through the Google Play Store

The provisions of this section apply to the App available through the Google Play Store. If any provision in this section conflicts with any other provision in our Terms or Privacy Policy, the provision in this section shall govern. By accessing and/or using the App, you acknowledge and agree that:

a. Acknowledgement. This Privacy Policy forms an agreement solely between the Company and you, and that Google LLC ("Google") is not a party to this Privacy Policy. Google will not be responsible for and will not have any liability whatsoever insofar as such liability arises from this Privacy Policy. Notwithstanding the foregoing, nothing in this section shall be read to modify or limit your or Google's obligations under the Google Play Terms of Use.

b. Defects or Performance Issues. If you experience any defects or performance issues with respect to the App, you agree that you will contact the Company and not Google.

c. User Information.

1. If you register for an account in connection with your use of the App, the Company shall have the ability to access, monitor, use, or disclose certain User Information that is available to you, and/or provided by you, in your account. As used in this Section, the term "User Information" means Personal Information that you enter into the App in connection with your access to and/or use of the App (including, without limitation, usernames, passwords, or other login information or Personal Information).
2. The Company shall have the right to provide such User Information to its service providers, subcontractors, sub-processors, and other third parties in connection with its provision of the Service to you, subject to the terms of the Company's Privacy Policy and applicable laws.
3. You hereby consent to the access, monitoring, use, and disclosure of your User Information by the Company and by Google, solely to the extent necessary to provide the Service, and subject to applicable laws.
4. If you provide User Information to the App which relates to your Google account, the App will only use such information to access your Google account with your authorization, and for the limited purposes that you have authorized; provided that the Company's use of User Information relating to a Google account may be deemed to have been authorized based on applicable privacy settings in your Google account.

VII. Links to Other Websites

As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link on our Site or via our Service. We encourage our users to read the privacy statements of other websites before proceeding to use them.

VIII. Changes to Our Privacy Policy

The Company reserves the right to change this policy and our Terms of Use at any time. We will notify you of significant changes to our Privacy Policy by posting the adjustments to the Privacy Policy on this page, and/or by placing a prominent notice on our Service, as we deem appropriate in our sole discretion. We may, and if required by law, will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via e-mail (if you have an account where we have your contact information) or another manner through the Service. Such changes will go into effect 30 days following such notification or the time period stated in our Privacy Policy. You should periodically check the Service and this privacy page for updates. In all cases, your continued use of the Service after the posting of any modifications to this Privacy Policy indicates your acceptance of those modified terms.
